THE South Wales Licensing Authority, Mr. R. R. Jackson, has refused an application by L. Ryan Holdings Ltd., of Nantgarw (Glam.) for a new B licence for 20 vehicles to carry "Colliery top material and coal within 40 miles ".
During the hearing, reported in last week's The Commercial Motor, it was submitted on behalf of the objectors that, as the applicant was engaged in processing waste material from tips, and carrying it to and from washeries, the work could be undertaken under a C licence. The Authority had then adjourned his decision to consider the matter.
In his decision, Mr. Jackson said that it appeared that the property remained with the National Coal Board and the
c16 charges made by the applicant were in respect of processing and collection and delivery only.
Mr. Jackson said that he agreed with the views expressed by the advocates for the objectors that, by virtue of section 164 (4)(b) of the 1960 Act, the material need not be deemed to be carried for hire or reward.
