THE importance of proper lega: representation before the Lic. ensing Authority is stresseC by the Transport Tribunal ir a written decision involving Henry Garner, trading as Prin: Removals of Coventry. ThE Tribunal upheld a two-vehiclE curtailment of the appellant's licence by the West MidIanc LA but allowed the operatoi to choose which vehicle: should be affected.

Following a visit to the ap. pellant's premises by a vehich examiner, the LA called thE operator to a public inquiry ir January this year. The day be fore the inquiry a letter wa: received from the appellan. which made a number of point! but said that he would not bf able to be present.

Before the Tribunal, the ap pellant was represented by M] Norman Carless and it was z pity Mr Carless had not repre sented him before the LA, sai( the Tribunal. "If the appel lant's case had been presente( to the LA in the way in whicl it has been presented to us, i seems more likely that the L/ would have taken a differen view of the matter," said till Tribunal in its decision.

The Tribunal said that tht main concern of the LA hat been concerning a number o delayed prohibitions imposec on vehicles together with till keeping of records. If the I../ had been presented with till information laid before th, Tribunal, his penalty woull probably have been different Accordingly, the Tribunal de cided to curtail two vehicle for six months, giving th, operator the choice of whicl vehicles.
