THE executive committee of the Road Haulage Association at a meeting last week decided to support Jacks Motors, Ltd., of Blackburn, in an appeal to Quarter Sessions. The company were originally found guilty by Blackburn Magistrates of failing to cause a correct driver's record to be kept. They appealed to the Divisional Court who ruled that if a driver went off on a " frolic " of his own, his employers could not be held responsible. The court remitted the case back to the justices to consider further whether the .driver was acting within the scope of his employment. At a second hearing, recently. the magistrates found that a considerable part of the journey undertaken by the driver was within the scope of his employment, and they decided to let their original conviction stand. It is against this second finding that a second appeal has been lodged.
