• FW Thorpe has been held to have acted unfairly in sum
marily dismissing a driver following a series of minor accidents.
A Birmingham Industrial Tribunal adjourned consideration of the amount of compensation to be awarded, after assessing that the driver concerned, Malcolm Davies, had contributed to his own dismissal by 25%.
The Tribunal was told that Davies had been sacked because the company had concluded he was careless.
It said that before his dismissal, Davies had not been given any valid warning about the way he drove his tuck. On 26 January he was involved in a further minor accident, and he was summarily dismissed after a disciplinary hearing on 1 Feb.
The Tribunal was of the opinion that a reasonable employer would not dismiss an employee for such conduct, without prior warning. However, it accepted that Davies' conduct had contributed to his dismissal.
