Which of the following most accurately describes the problem?

excess of 30cwt but gross weight of not more than 3.5 tons. Recently I was stopped by the police and told! would be reported for possible prosecution because did not have a carrier's licence. I explained that I did not need one but they insisted that I did. Could you advise me whether they are right?

AA vehicle which is plated at a weight not

exceeding 3.5 tons does not need a carrier's licence and after March 1 it will not need an operator's licence. If your vehicle is of an age that requires it to have been MoT tested and plated prior to the date on which you were stopped you have committed two offences: failing to have the vehicle tested and operating it without a carrier's licence, the latter because a carrier's licence is required if the vehicle exceeds 30cwt unladen and is not plated.

If your vehicle is not yet due for MoT testing and plating due to its age (first registered in February or March 1961-1967 or after January 1 1968) you are committing the same offence of not having a carrier's licence for a vehicle exceeding 30cwt unladen. If it was first registered after January 1 1968 then it should have a manufacturer's plate affixed to it and if the gross weight shown does not exceed 3.5 tons then you are not committing any offence by operating without a carrier's licence.
