Local residents have failed in a bid to remove the operating centre of a Lincolnshire haulier from its licence.

However Eastern Traffic Commissioner Geoffrey Simms has imposed conditions on the licence belonging to Ingoldsby-based T Jasinski IL Partners relating to the use of a pressure washer and the length of time engines can be run before vehicles leave.

The firm. based at Little Scotland Farm, Ingoldsby, which holds a licence for two vehicles and three trailers, appeared before the IC at the five-year review stage following complaints from local residents. One resident, Tony Glaves, produced a meticulous log covering the period from June 1995 to October 2001, detailing the nature of the alleged nuisance. He particularly complained about the use of a pressure washer in the evenings, at weekends and on bank holidays. He also said that sleep had been disturbed on occasions by vehicles running their engines before leaving at unsociable hours. He had little contact with the principal partner Mark Jasinski, whom he found to be brusque and aggressive when approached with a complaint. Similar evidence was given by three other residents.

Jasinski said the vehicles normally left in the morning and returned the same evening, but operational reasons gave rise to the need for the occasional early start, and his business would be adversely affected if the working hours were restricted.

There had been a succession of complaints to the local authority, only two of which were noise related, and none of which had been substantiated on investigation, said Jasinski.

The IC said that a careful scrutiny of Glaves' log between July 2000 and October 2001 revealed only eight references to lorry movements. Of those, four might justifiably be considered departures at unsociable hours, insufficient to justify a condition limiting the hours of operation. There had been no significant change in the nature of the transport operation since the licence was granted in 19111. Therefore any visual intrusion would have been apparent to the complainants when they took up residence.

He imposed conditions limiting the use of the pressure washer to 07:0019:00hrs Monday to Friday and 08:0016:00hrs on Saturdays.
