THL TRANSPOR iftihunal has refused to return an impounded vehicle to Construction Access UK.

North-Eastern Traffic Commissioner Tom Macartnev impounded the vehicle after it was stopped in October last year running in the livery of Independent Scaffolding.That company's 0-licence had expired at the end of August 2005, and the driver said that he was employed by Construction Access UK.

Inquiries revealed the truck was under a lease agreement with First National Bank. A Companies House search revealed that Independent Scaffolding had been the subject of a compulsory winding-up order in July 2005. Construction Access UK was set up in December 2004; its director, Albert Dugdale, had previously held an 0-licence in his own name trading as Independent Scaffolding. Seeking the vehicle's return, Construction Access UK said it had believed it held Independent Scaffolding's 0-licence. It had not received the renewal reminder because its post had been redirected to the official administrator. The vehicle was registered in the company's name and payments under the leasing deal had all been made on time.

Dismissing the appeal,theTransportlribunal said a registration document was not proof of ownership. As the leasing deal was still in force, the Tribunal decided it was more likely that the vehicle was actually owned by First National Bank.
