Haulier John Robinson, based in Caernarfon. lost his two-vehi cle licence when he failed to appear at a Prestatyn disciplinary inquiry before Welsh Traffic Commissioner David Dixon.

Traffic examiner Richard Mill said that in June 1999 a two-axled tipper carrying tarmac and driven by Robinson was stopped in a check. All the centre field entries had been completed on Robinson's tachograph chart for that day, apart from the driver's name.

Robinson could not produce a tachograph calibration certificate or two-year check certificate. When asked why the checks had not been carried out, he replied: "Negligence on my part".

Enquiries revealed that Robinson did not have an HGV driving licence. When interviewed about that, and the fact that he was driving without insurance, Robinson said he held a PSV licence and one of his drivers had left the firm that morning.

Mill concluded that Robinson's motive for leaving his name off the tachograph chart was his lack of the appropriate driving licence. Robinson was subsequently prosecuted and fined a total of £3400.

The IC said that a prohibi tion had been imposed on one of Robinson's vehicles for suspension and steering defects in February. The vehicle examiner had reported that there was only one inspection record for one vehicle and two for the other over a 15-month period, and there was no forward planning system.

Revoking the licence, and directing that any fresh licence application should be heard at public inquiry, the TC said that Robinson had failed to fulfil undertakings given when the licence was applied for. He had no information before him about Robinson's finances so he could net be satisfied that he had adequate financial resources.
