Is it right to say a vehicle can stop on a motorway to permit a person to recover an object that has fallen on the motorway and to permit a person to help another in that situation?
The Highway Code says that if anything falls from a vehicle on a motorway, use the roadside telephone to inform the police but do not try to retrieve it yourself. Which is right?
A The two exemptions from stopping on a motorway you refer to are correct. They are contained in Regulation 7(2) (c) & (d) of the Motorways Traffic (England and Wales) Regulations 1982.
You might also consider Regulation 13 which states that a person may not go on foot on any part of a motorway other than the hard shoulder, but exception is made for a person to recover or move any object which has fallen on to a motorway or to give help which is required by any person in any of the circumstances specified in Regulation 7(2).
The Highway Code quote is sound road-safety advice, but not law.
