Which of the following most accurately describes the problem?

• A bitter three-year legal battle ended this week when a haulage firm agreed to pay 24,500 damages to food company Nestle.

The fight began after water seeped into a load of dehydrated sliced mushrooms being hauled by Nelhams Transport Services of Reading. The 200 cartons of mushrooms — valued at 221,500 — were delivered from Colchester to Aylesbury in September 1984, but when they arrived they were soggy and ruined.

Nestle and Germany operator EH Worlee sued Nelhams, run by Alan Nelham of Duffield Road, Woodley, Reading for negligence, saying that the shippers should have kept the mushrooms dry.

Nelham agreed to pay 24,500, although formally denying negligence.
