Which of the following most accurately describes the problem?

• A new licence for 14 vehicles and 28 trailers, with a margin for an additional six vehicles and seven trailers, was granted to Lovell's Transport, of London, last week by the Metropolitan LA, Mr D. I. R. Muir.

Mr J. H. Forsythe, a director of the company, said there might have been confusion over the fact that this was a new company formed to carry out road haulage for the Lovell's Transport and Shipping Group. He said that confusion over the new company had resulted in the grant of a transitional licence under the provision of the Transport Act although a carrier's licence had never been held. An associate company, Shaw Lovell and Co, had held an A licence and it seemed, therefore, that

misunderstanding had arisen as to whether a new company had been formed or whether there had simply been a change of name.

Mr Forsythe admitted offences of excessive smoke, dangerous parts and the use of unplated trailers. Mr Muir mentioned that a vehicle examiner's report appeared unusual in that the trailers operated were in good condition but this was not the case with the vehicles themselves.

Before he granted the licence Mr Muir was told by C. A. Hayes, the transport manager, that as a result of advice from the vehicle examiner, the maintenance and recording system had been revised.
