Appeal dismissed by Transport Tribunal
A CHESHIRE haulier, who failed to comply with an undertaking which led to the granting of his interim licence and who also failed to carry out his duties as transport manager for another haulier, has lost his appeal against the refusal of his application for a substantive licence.
Mark Skellern, based in Congleton, had applied for a licence for two vehicles and two trailers before the NorthWestern Traffic Commissioner Beverley Bell. Skellern was the nominated transport manager on a licence held by Sandbach-based Alan Bowyer.
The TC was told that Bowyer had no maintenance records for a six-month period and that he had said that Skellern did not play an active role in the business. Skellem's inspection records showed defects that had not been rectified, many of which would have been prohibition items.
Holding that Skellern had lost his repute, the TC said she was extremely concerned about one of his inspection records, which was so bad that it ran to three pages. She was satisfied that Skellern had put commercial considerations above road safety, and that he had let Bowyer down.
The TC added that Skellern had allowed his name to be put forward when, in fact, he was the transport manager in name only and had not undertaken any duties as transport manager (Transport manager loses repute', CM 17 January).
Skellem's appeal was dismissed by the Transport Tribunal.
