NORTH LONDON-BASED Glebe Transport has lost its appeal against the refusal of the company's licence application by the then South-Eastern and Metropolitan Traffic Commissioner Christopher Heaps on financial grounds.

The company had initially sought a one-vehicle national licence but amended its application to one for a restricted licence.

The Traffic Area Office had made numerous requests for the production of satisfactory financial evidence, and in October the company submitted a bank statement showing a balance of 0,200. In January the TrafficArea had requested monthly bank statements covering the period from the setting up of the account until the end of December.These showed that the funds providing the opening balance had been removed on 15 November, having been left in the account for 20 days.

Glebe had appealed against the TC's decision on the grounds that: the requested documentation had been supplied; that the company was fairly new and had limited funds; and that a cross guarantee could be offered from a sister company which was the main fund holder.

Appearing before the Tribunal, director Annette O'Connor said a sister company, Westgate Building Services, whose bank statements had originally been supplied but were rejected by the TAO,was the source of funding and financial support. She admitted that no cross guarantee had been put in place and that there was no overdraft facility.

Dismissing the appeal, the Tribunal said it was too late at this stage to offer a cross guarantee that might previously have satisfied the TC.
