A DERBYSHIRE HAULIER must wait to see if he can keep his 0-licence because of concerns over whether he was being manipulated by a father and son to enable them to stay in business.

Alfreton-based Alec Ridley, trading as Ashlield Distribution, holds a licence for five vehicles and four trailers. He appeared before North-Western Traffic Commissioner Beverley Bell.

The TC pointed out that transport manager John Murfin had lost his repute when his own licence was revoked in October 2004 by Deputy TC Elizabeth Perrett. Murfin told her he will be resigning at the end of the month. Vehicle examiner Cohn Brown said Ridley had been operating six vehicles and nine trailers; one vehicle had been operated without a test certificate throughout 2006.

Maintenance was handled in-house by Andrew Murfin. There were no safety inspection records or defect reports for the trailers and one vehicle. The vehicle inspection records were not satisfactory and some were missing. No mileages were entered, which brought the validity of the records into question, particularly as one was dated New Year's Day The TC pointed out that the dates on many of the inspection records had been altered.

Traffic examiner Caleb Moore said an examination of tachograph charts revealed unrecorded distances and drivers driving for up to seven hours without taking the required breaks.The vehicles' livery showed Andrew Muffin's mobile number as a contact number rather than Ridley's. Documents relating to the lease for the premises were signed by Andrew Murfin,as was a contract with a customer. His impression was that the business was being run by Andrew Murfin.

Ridley maintained that he was in fact the owner of the business, explaining that Andrew Murfin worked for him in a number of ways TheTC is to announce her decision in writing.
