Which of the following most accurately describes the problem?

which is fitted with a CAV rotary injector pump. The cold start device is not an excess fuel type, but is one which fully retards the injection, requiring the knob to be held out until the engine is running. Could this control be legally mounted in the cab?

fuel type it will be legal to position it where it can be operated from the driving seat.

If, however, the device did facilitate the supply of excess fuel it could not be fitted in that position. Regulation 23 of the Motor Vehicles (Construction and Use) Regulations 1966, No. 1288, lays down that where a motor vehicle is equipped with a device designed to facilitate the starting of the engine by causing it to be supplied with excess fuel the device, and any apparatus to operate it, must be fitted in such a position that it cannot readily be operated by a person while he is being carried by the vehicle.

However this Regulation does not apply if the device is so designed that after the engine has been started it cannot cause the engine to be supplied with excess fuel or it does not increase the emission of smoke.
