Two Merseyside operators have lost their appeal to the Transport Tribunal against the deletion of their operatkig centres from their 0-licences on road safety grounds.

David Lawton, trading as Ramhill Express Deliveries. and Anthony Woods, trading as Premier Scaffolding, had appealed against the decision of North Western Traffic Commissioner Beverley Belt At their five-year reviews she removed the site at Dolph Lane, Prescott, where they had been based since 1991. Road Runners Merseyside aLso operate from the site—Deputy IC Patrick Mulvenna removed It from the Road Runners licence in September 2000 but this decision was overturned by the Tribunal.

Jonathan Lawton, appearing for the two operators, pointed out that other companies used the site; there had been no accidents there for at least 25 years; and there had been no evidence from either the police or the local authority. The evidence was the same as in the Road Runners case and the IC had based her decision on a presumption of danger for which there was no new evidence.

Disagreeing, the Tribunal said that the road safety factors which had influenced the TC were based on incidents mentioned

at the public inquiry by representors the traffic examiner, and on the impr sion she gained during a site visit.

The traffic examiner had updated report since the Road Runners c: Though she stopped short of indica' that in her professional opinion the was dangerous neither did she did sa was safe.

Directing that the site cease to specified on the two licences at midn on 15 December, the Tribunal said there now been ample warning that the operators might have to find new opei ing centres. They had been given s months to look for an alternative.
