Q. Our delivery driver's job entails the collection of cash from customers. He recently returned to base on a Friday and deposited his documents and cash as normal. The paperwork did not get reconciled until the following Monday morning when staff discovered a significant sum of money missing when compared against his paperwork Worse still, the driver didn't tarn up for work either. Is our MD correct in wishing to sack the driver immediately?

MANAGEMENT WOULD I3E much better advised to follow the ACAS code of practice on discipline and dismissal. An employment tribunal might find in the driver's favour if the company has not followed the correct procedure and allowed him the opportunity to present his ease, even if the driver was subsequently convicted of the theft. He should he allowed the opportunity to present a defence. For example, weekend staff may have had the opportunity to steal the cash, the driver may have been genuinely sick (with a doctor's note) on the Monday.
