A MONEY-LENDER failed to convince a Traffic Commissioner to give it an impounded vehicle which it claimed had been offered as security on a 17,000 cash loan. The vehicle's owner, Lee McKibbin,trading asYardley Grab Hire of Preston, and Redditch-based Mobile Money both claimed ownership when they appeared before North Western TC Beverley Bell.

Traffic examiner Peter Ilsley said when the three wded tipper carrying soil was stopped it had no 0-licence disc or excise licence on display. Asked why he was using the vehicle without a licence, McKibbin had replied that he had to earn a living.

McKibbin said there had been some confusion over whether he needed a licence as a paving contractor. He had bought the vehicle from Clive Hurt Plant Hire for £24,000; his father provided the money. He had used it for security against a £7,000 loan from Mobile Money four months ago which he had not yet repaid.

Chris Quinn, northern area manager of Mobile Money, said including interest, a total of £9,125 was due to be repaid by 25 May. McKibbin was given until 23 June to make repayment in full. Part of the agreement was that, on default, ownership of the vehicle transferred to Mobile Money.

Refusing to release the vehicle to either party, the TC said she was satisfied that McKibbin was its owner. But she was also satisfied that he knew of the need for an 0-licence and chose to ignore that requirement.
