Kings Cross Scaffolding applied to South Eastern & Metropolitan Traffic Commissioner Christopher Heaps. He heard that in June a rigid vehicle loaded with scaffolding was spotted in flornsey Road. London N7 without an 0-licence disc; the driver said he was employed by Kings Cross Scaffolding.

Enquiries revealed that that company did not have an 0-licence. When interviewed director Tony Fletcher said he thought the company had applied for a licence.

Fletcher subsequently applied for the return of the vehicle but did not include any reasons in the application form, which was submitted by solicitors and contained the words "to follow". The TC said that in July the Traffic Area Office phoned the solicitors and reminded them that no details had been supplied. A response was requested by the beginning of September.

No submissions had been received from Fletcher, the company or the solicitors.

Kings Cross Scaffolding applied for a restricted licence in December 2000. The application was signed by Fletcher but was incomplete it was refused in September 2001.

In the absence of submissions in support of the application, and on the basis that the company's application for a licence in 2000 demonstrated its knowledge and Fletcher's knowledge of the need for an 0-licence, Heaps said he could not be satisfied that Fletcher did not know the vehicle was being used without licence authority.
