• A haulier who was fined for exceeding his driving hours after being held up in roadworks has won his appeal to quash the ruling.

Lincolnshire-based Stephen McFarlane was not given the opportunity to record the season for the 30-minute discrepancy on the back of his tachograph chart when a traffic examiner approached him at the M1 Woodall services earlier this year (0424-30 June and 1925 Aug). He was fined 1300 and

has spent months fighting the decision.

After hearing the evidence last week, Sheffield magistrates dismissed the case. McFarlane, who has held an unblemished HGV licence for 22 years, says: "I was elated when I heard the decision. But it was clear all along that I hadn't breached any rules."

He adds: "It just goes to show that if you know you are in the right you can fight them and win."
