TUDGMENT was reserved at Chester held County Court last week in a claim for .163 2s. damages made lay Chesterfield Transport Department against Robinson's Transport, Ltd., Middlesbrough.

The corporation alleged negligence and nuisance by the defendants in causing a blockage of the highway at Engine Hollow, Barlow, near Chesterfield, last NovemlYer.

Mr. A. Sharp, for the corporation, said that the blockage occurred at 8.30 a.m. on November 25 last year, when a half-shaft on one of the company's vehicles, which was carrying an excavator, broke. The blockage was not removed until November 28, although bulldozers on a nearby open cast coal site could have been used to move the vehicle.

The vehicle was "very much overloaded," alleged Mr. Sharp, adding: "The total maximum towing capacity was 50 tons, and the excavator being carried weighed over 80 tons." , Mr. C. L. Marsden, the corporation's traffic superintendent, said that the £63 2s. was the Cost of re-routeing the buses, For Robinson's Transport, Mr. W. A. Sime, said: " The vehicle had a police escort, and to say that it was overloaded is to allege that the police were aiding and abetting an offence. My client took every reasonable step in getting the obstruction moved as quickly as possible."
