THE REFUSAL OF the West Midlands Traffic Commissioner David Dixon to return an unlicensed recovery vehicle impounded last September while carrying five burnt-out cars has been upheld by the Transport Tribunal.Kenneth Richards had appealed against the decision, saying he had since applied for and been granted an interim licence and that his failure to have one before had been an innocent mistake.

The TC was told the vehicle had displayed an outof-date 0-licence disc issued to a limited company.

Richards said he had bought the vehicle with the intention of going into recovery work. He had not obtained an 0-licence as someone he worked for had said he could run on his licence. In June 2000, Richards had been convicted of unauthorised use. Richards told the TC that he had been attending courses on recovery work but had not discovered he needed an 0-licence to carry more than two cars at a time receiving a letter from the South Wales and G Recovery Group.

Dismissing the appeal, the Tribunal said it was Richards either knew or ought to have known tl 0-licence was required.
