Which of the following most accurately describes the problem?

A DISTRIBUTION contract won by TNT Network Logistics has sparked a dispute over drivers' pay.

The Transport & General Workers Union says a dozen drivers who deliver for DS Smith Packaging in Derbyshire were transferred from AAG Distribution to TNT at the beginning of last month (February).

T&G regional industrial organiser John Evans says the TUPE transfer of undertakings regula tions have not been honoured because the drivers have lost the guarantee of 31 hours-a-week "driven time".

"They are on around 2% more when driving so ifs an integral part of ensuring their earnings don't drop." he explains. "They're only getting 23 hours at this rate at the moment."

A spokesman for TNT says the TUPE regulations have been fully complied with.
