South Eastern 86 Metropolitan Traffic Commissioner Brigadier Michael Turner has adjourned consideration of disciplinary action against West Moleseybased W&W Foods.

The company had been called before the TC at an Eastbourne disciplinary inquiry to answer allegations that it was in breach of an undertaking on its licence because one of its drivers had been regularly breaking speed limits.

For the company, James Backhouse argued that the only undertakings that could be recorded on the licence were those that were laid down in the 1995 Act. These covered drivers' hours, overloading, maintenance and operating centres.

A TC was not entitled to enforce an undertaking to do with speeding, said Backhouse. He added that only one of the company's six drivers had allegedly been speeding.

Adjourning the hearing. Turner said he wished to consider if there had been a material change in circumstances since the licence was granted. This would include deciding if the company was a fit and proper firm, now that its tachograph charts showed a driver had been speeding.
