Which of the following most accurately describes the problem?

• Five vehicles were removed from the 11 vehicle licence of Mr F Gillard of Burrowbridge last week when he appeared under section 69 before the Western LA, Mr J. R. C. Samuel-Gibbon at Taunton.

The inquiry had been called because Mr Gillard had failed to disclose on his licence application form that he had had overloading convictions in 1969 as well as one in 1968 for procuring a driver to make a false record. Mr Gillard denied any intention to deceive but said the statements were due to a faulty memory.

At the same hearing an application by Gillard's Farm and Transport was heard for a licence to authorize nine vehicles and 15 trailers with a margin of six vehicles and 15 trailers. This application was made to replace the licence held by Mr Gillard and evidence was given to show that a new company had been formed to amalgamate the family farming, forage merchants and road haulage businesses. Six vehicles and 15 trailers, with a margin of five trailers to be acquired, were granted.
