E Odra Shipping Agency's appeal

(The Commercial Motor, May 21) against the refusal of a B licence for two small vehicles with a 25-mile radius, has been dismissed by the Transport Tribunal in a reserved, written decision.

The original application was for two vehicles of 19 cwt. and 30 cwt. capacity, with the proposed condition: "Mainly textiles, also wines and spirits, machinery and generally any goods our clients buy or sell. In Greater London area, inclu ding London Airports (Heathrow and Gatwick)."

At a suggestion "emanating from the office of the Licensing Authority", the proposed condition was amended to: "General goods, mainly textiles. wines, spirits and books, within 25 miles." The appellant wished to carry consignments not exceeding 1 ton in weight, larger consignments being sent by other hauliers.

The Tribunal, whilst admitting that the appellant (Mr. W. E. Choroszewski) "conducted his own case with considerable ability ", agrees with the deputy LA that if four writers of supporting letters had really been in difficulty about transport they would have attended the inquiry to give evidence.

The appellant would have beers content with the smaller of the two vehicles and would have accepted a "limitation that he should carry only the goods of his regular customers" using "the full 'range of his agency services ". Though "it would probably be more convenient for the appellant to have a vehicle under his own control ", the evidence "fell far short of showing that there are not sufficient transport facilities available...".
