Which of the following most accurately describes the problem?

Drivers' hours and tachograph offences have cost a Bolton haulier and three of his drivers £12,980 in fines and costs.

Liaquat All Majeed, trading as LAM Haulage, pleaded guilty by letter to two offences of unauthorised use of vehicles, four of failing to produce tachograph records, two of failing to use a tachograph and 18 of per

mining drivers to take insufficient breaks and rest.

The Leigh magistrates fined him a total of £10,600 with £35 prosecution costs.

William Tatlock pleaded guilty to two offences of failing to use a tachograph, three of taking insufficient daily rest and one of insufficient weekly rest; he was fined £840 with £35 costs.

Ronald Nugent pleaded guilty to three offences of failing to use a tachograph, one daily rest offence and five of driving for more than 4.5 hours without taking the required break; he was fined £1,260 with £35 costs. Thomas Nugent admitted one daily rest offence; he was fined £140 with £35 costs.

Prosecuting, Alan Bakkar said Majeed had been operating four vehicles during May and June when he was licensed for only two. Police received information that Majeed's drivers were working excessive hours, and weighbridge tickets from various quarries revealed offences when they were compared with the relevant tachograph charts.

On one occasion Tatlock had taken as little as three hours' rest; on another Ronald Nugent had driven for seven hours with a break of only 28 minutes. Majeed was responsible for ensuring that all his drivers complied with the regulations, said Bakker, adding: "It is evident that Majeed fails to ensure that they comply, as he is the person who issues the work on a daily basis to the drivers and as such is aware of what each driver does."

The magistrates ordered that the fines and costs be paid within 28 days.
