SOUTH EASTERN Traffic Commissioners have decided not to renew a psv operator licence held by Mr Collins, trading as ICC Tours. Their decision was taken after the Commissioners had considered the operator's history of poorly maintained coaches and unsatisfactory maintenance records.

Maintenance failures led to the loss of psv vehicle licences in 1976 and 1980, and in 1981, despite the operator receiving two immediate and three delayed psv 414 prohibition notices, the Commissioners issued an Operator's licence for four vehicles as the vehicle examiner at that time was satisfied that maintenance standards were improving.

The licence was to run until January 31, 1984.

In September 1982 the Commissioners made no order despite the operator being issued with three more immediate and one delayed psv 414 notice. They decided at this time that a new fleet engineer should be given a chance to improve matters.

ICC Tours coaches received four immediate and two delayed prohibitions between February and October 1983 and an additional vehicle failed to obtain an annual test certificate.

In deciding not to renew the licence the Commissioners looked at several previous appeal decisions before concluding that the fleet engineer had failed to fulfil promises made in September 1982 and that Mr Collins had not taken action necessary to ensure that his obligations as licence holder were met.
