• A Gloucestershire man has failed in his bid to use his terraced council house as the operating centre for a 6.6-tonne van.

Ian Davis, trading as A Man and A Van, had applied to base the vehicle at home in Dill Avenue, Hesters Way, Cheltenham, before Western Deputy Traffic Commissioner Lester Madre!l at a Cheltenham public inquiry.

The application was opposed by Cheltenham Borough Council.

Davis said he was proposing to operate a furniture removal business around the Gloucester and Cheltenham areas. The vehicle would only be at Dill Avenue overnight when it was empty.

After Davis said he had previously held a PSV Operator's Licence for a 17seater minibus based at the same address, 1VIadrell pointed out that the considerations relating to operating centres for the two types of licence were completely different.

told the Deputy Commissioner that Davis might be in breach of his tenancy agreement. They were con cerned about disturbance and nuisance to other residents and about the proximity of a neighbouring primary and junior school. However, they conceded that so far they had not received any complaints about Davis's activities.

Stephen Clark, proprietor of A Man and A Van, said he supplied vans on a lease basis to people such as Davis and obtained the work for them. The intention was for Davis to carry on doing what he had been doing in the past except with a vehicle that required an Operator's Licence.

Madrell refused the application after visiting the site.
