Lorries as "Hackneys."

In the King's Bench -Division, on Thursday last, before the Lord Chief Justice and Justices Shearman and Salter, the appeal of the Norfolk County Council was heard against the dismissal of a-summons by the Dereham Justices against; Messrs. Wright and Co, for using a lorry for 'conveyanceof passengers. • Mr. Wootton, K.C. (instructed by Messrs. Griffith. and Son), appeared for the appellants, and Mr. D. N. Pritt (instructed by Messrs. Engall and Crane for the Motor Trade Association) for the respondents.

Opening the appeal, Mr. Wootton, KC., stated it was agreed that, having regard to the decision in the Wood case, which had been heard since the statement of the present " ease " by the magistrates, the present appeal must be dismissed; but, with the consent of the respondents, and at the wish of the Ministry of Transport, he asked the Court to give a ruling as to the legal position of lorries generallu when lent on hire. Could thee,' be hackney carriages?

The Lord Chief Justice, after consulting with the other judges, said the court viewed 'such a course as undesirable. The present case rested upon a summons issued under Section '6 /,3) of the Roads Act, which had been properly dismissed

by the magistrates. This court could only confirm that decision, and dismiss the County Council's appeal with casts. If their lordships added their general views, as seemed to be desired by both parties, such would only be in the nature of *biter dicta, and would not be binding as precedent on any other case.
