ABATTLE between the Western S.M.T. Co., Ltd., and two smaller operators, McGill's Bus Service, Ltd., and Graham's Bus Service, Ltd., for the right to supply bus services on the withdrawal of the trams from Paisley has been won substantially by Western S.M.T.

After nearly a year's delay, the Minister of Transport announced last Friday that he had dismissed seven out of nine appeals by McGill's. One of their appeals was wholly allowed and another in part. All four appeals by Graham's were rejected. Decisions by the Scottish Traffic Commissioners were in dispute.

During the inquiry by Mr. J. J. Cunningham, QC., at Glasgow' on November 19 and 20 last year. there was argument on the onus of proof resting on the appellants, The Minister says that in exercising his powers he has to satisfy himself whether or not the Commissioners' decision ought to be disturbed on the merits of the case.

The whole of the evidence available by way of documents produced at an inquiry is to be considered and the matter is decided on its merits. The following appeals by Graham's have been rejected:— Against the refusal of new services from Paisley (Elderslie) to Hillington and ' Renfrew Ferry. Against the grant to Western S.M.T. of a new service front Paisley (Elderslie) to Renfrew Ferry Against increased duplication granted to Western S.M.T. on 39 services.

Graham's gave notice of appeal on 13 other grants to Western S.M.T. but as they had not objected to the application they had no right of appeal.

Cooper (Sand • and -Gravel), Ltd., Sunderland, when they appeared at Stockton last week. Mr. F. W. B; Pacey, 'prosecuting, said.a "concern who supplied slag ballast to Durham.

• County Council used Cooper's C-licence •• lorries for .deliveries. Police saw ,three vehicles engaged on this work.

'Cooper's, who pleaded "not • guilty," claimed that the work was legal because they did a certain iniotint of grading to the slag. Therefore, the goods had been delivered "subject to a treatment Or process in their course of trade."

21,541 NEW VEHICLES L'XCLUDING cars and motorcycles, 21e441 new vehicles were registered in July, conipared with 19,773 in June. Details are given in the accompanying table.
