A Wrexham-based waste operator allowed his 32tonner to he used at speeds up to 100km/h because of a defective speed limiter, a court heard.

Andrew Imrie and two of his drivers, Michael Box and Stephen Thomas, were ordered to pay fines and costs totalling £1,760 by Wrexham magistrates.

Imrie, who trades as Grafters, pleaded guilty to one offence of failing to maintain a speed limiter and eight of using a vehicle when the limiter was not restricting its speed. Box pleaded guilty to one offence of using a vehicle when the speed limiter was not properly maintained and 11 when it was faulty. Thomas pleaded guilty to three offences of using a vehicle with a faulty speed limiter.

Prosecuting for the Vehicle inspectorate, Les Jones said that at the request of the police, a rigid belonging to Imrie and driven by Box was examined last November after tachograph records had shown that its speed was not being limited. It was found that the operating cable was broken and detached from the fuel governor lever. Further tachograph record were produced and thes showed that the vehicle ha been frequently used with defective limiter, recordin speeds up to100keVh.

Andrew Woolfall, appearin for Imrie and the two driver: conceded that the speed limite had been defective since I August. However, he told th court that the driver had nc been tampering with the lie iter—the cable linking two part of the equipment had broke and this should have been spot ted during two routine maintc nance inspections.
