■ N OPERATOR who is at the limit of his bank overdraft acilities and admitted having no other capital had his licence pplication adjourned by the North West Deputy Licensing Luthority, Mr J. H. Levin.

Mr J. B. Shagouri trading as gency Clearance and Light ransport of Oakmere, heshire had applied for a cence for one vehicle in )ssession with one vehicle to e acquired.

Mr Shagouri admitted that e was at the limit of his over-aft facilities of £800. He said e earned about £80 per week Id the wastepaper and cardpard recycling part of his asiness had a cash return ifficient to . maintain the osiness including the tintenance of the vehicle but was insufficient to build-up ty capital. He worked on a cash basis paying for servicing at the time it was done.

He also undertook garden clearance work but that was very seasonal. He was seeking a licence to carry other peoples' goods and when he had received a restricted interim licence he had had to stop carrying for hire and reward. That was one of the reasons for the present financial situation.

Mr Levin said he realised that it was a "Catch 22" situation in that the licence was necessary to build-up capital but a licence could not be granted unless there was capital. However, Mr Shagouri was going to be in trouble if he fell sick or needed a new engine. It was hand-to-mouth and he was not convinced that Mr Shagouri had sufficient financial resources at the moment.

In such circumstances he could not grant a licence.

After hearing that Mr Shagouri also required to sit an examination for a Certificate of Professional Competence Mr Levin adjourned the application saying that when Mr Shagouri again came before him he would need to be satisfied about both finance and professional competence. In the meantime the existing interim licence would be continued.
