DRIVER'S HOURS offences cost Penyffordd, Flintshire-based Mark Kynaston and three of his drivers 17,650 in fines and costs when they were called to appear before Wrexham Magistrates.

Kynaston, a partner with his wife, Audrey, and trading as M & K Kynaston Haulage, pleaded guilty to permitting 13 offences of exceeding 4.5 hours driving without the required break and three of exceeding the daily driving limit.

He was fined £4,800 and ordered to pay £350 prosecution costs. Philip Simons pleaded guilty to three 4.5-hour driving offences and one daily driving offence. He was fined £400 with £300 costs.

Anthony Catherall pleaded guilty to six 4.5 hour driving offences and one daily driving offence. He was fined £700 with £300 costs.

John Williams pleaded guilty to five 4.5-hour driving offences and one daily driving offence. He was fined £500 with £300 costs.

The court was told that in November, Kynaston had been requested to produce the tachograph records for October. Subsequent study of the 117 tachograph records that were produced revealed a number of apparent offences.

When interviewed, Kynaston said that he analysed the record sheets himself and he had brought any offences to the attention of his drivers.

However, he did not think that disciplinary action was necessary, it being better to discuss rather than to discipline.
