Which of the following most accurately describes the problem?

My fast-track vehicle was towing a trailer when it was stopped by police. The fast-track is licensed as private/light goods and uses ordinary diesel. The driver has a B and C1 licence only, but passed his test prior to 1 January 1997. He is being charged with driving without a proper licence. Is this right?

The driver needs a C+E licence because the unladen weight of the trailer is over 750kg. Taking the test prior to 1997 does not confer ‘grandfather rights’ . The fast-track should also be taxed as a general haulage vehicle.
