WHEN VANDALS prevented a firm from using its authorised operating centre, it illegally parked its one vehicle in a lay-by close to the operator's home.

Western Traffic Commissioner Philip Brown cut the three-vehicle licence held by Nicholas Wastie and Lisa Rodham Wastie, trading as Wastie Cleansing Services, of Gosport, to one vehicle. He gave them a week to seek authority for a new operating centre.

The TC was told the firm's vehicle was parked in a lay-by close to the partners' house instead of at its authorised operating centre at Fareham because of problems of vandalism and theft. Nicholas Wastie said he had difficulty finding a new site, but now had permission to use the Havant Lorry Park.

Vehicle examiner Tim Collins said that when he examined the vehicle in October it was free of defects, but there were periods of up to four months between inspections. Wastie had told him his maintenance contractor had gone out of business and it had taken longer than anticipated to find another one The vehicle had been presented for annual test five times in 2005 before it passed and had failed again in March 2006.

For Wastie, Paul Carless Junior said the problem had been relining brakes too close to the annual test. In future the vehicle would be the subject of a multicheck at the test station three weeks before the test.

Nicholas Wastie said the problems at his operating centre had started a couple of months after the licence was granted in December 2004. He knew he was breaking his licence conditions but had no alternative. as otherwise his business "would have gone down the pan". He accepted he was effectively still operating illegally from an unauthorised operating centre.

The TC said the firm had used an unauthorised operating centre through most of the period of the licence.
