AN OPERATOR who failed to turn up to a public inquiry and had his licence revoked, has lost his appeal to the Transport Tribunal.

Liverpool-based coal merchant R, A. Swain (Waterloo) was called to public inquiry before North Western Licensing Authority Roy Hutchings, but its managing director Thomas McCormick failed to arrive. Mr McCormick's counsel Tania Griffiths said that he had not realised the seriousness of the situa

tioae also argued that had Mr McCormick turned up, his licence would not have been revoked. The LA would then have found out that the immediate GV9 prohibition given in May 1984 was not because Mr McCormick's one vehicle was in a dangerous condition, she said.

She also stated that Mr McCormick's records were better than realised. The records the vehicle inspector saw were 'not a complete history of the matter," she said.

She also told the Tribunal that since Mr McCormick's mother had died in 1980, he had lost much of the driving force behind the business but had gained much more work. Mr McCormick had never really learned the business of making records properly, she said.

In dismissing the appeal Judge Inskip said that the loss of the operator's licence would not come into effect until August 16.
