CROSS appeals against a decision of the Scottish Deputy Licensing Authority were dismissed by the Transport Tribunal in Edinburgh last week. F. and F. Transport, Ltd., a company formed in January, 1955, had bought a unit of 14 vehicles from British Road Services. The Authority had granted them an extra vehicle and indicated that he would he prepared to grant short-term B licences to Cover peak traffic periods connected with farm work.

The company appealed against this decision, having originally applied to add four vehicles to their fleet. Eight objectors appeared before the Licensing Authority, but only four of the parties appealed against the Authority's decision. They were the railways. B.R.S.. the Scottish Co-operative Wholesale Society and Messrs. J. G. Gilmour and Son.

For F. and F. Transport, Ltd., Mr. D. M. Ross submitted that the Authority must have appreciated that extra vehicles were required or he would not have been prepared to grant short-term B. licences. Mr. J. M. Cowan, Q.C.,. for the nationalized undertakings; opposed both the Authority's grant and the company's wish to add four vehicles to their fleet.

The president said that the figures produced by F. and F. Transport, Ltd,, did not show that their, business was, rapidly expanding, but was rather static after April. The Tribunal were not satisfied that a case had been made out for more vehicles than the Licensing Authority had granted. "The position, remains the same," he commented.
