WHEN a West Hartlepool haulier, Mr. J. R. Henderson, and three of his drivers, appeared at West Hartlepool Court -to answer 41 summonses under the Road and Rail Traffic Act, Mr. T. H. Campbell Wardlaw, defending, stated that with the exception of eight charges there was no case to answer.

The charges included failure to keep records, allowing a driver to drive for more than 51 hours without rest, and carrying unauthorized goods. The magistrates dismissed all charges except 11. These comprised nine charges of permitting drivers to carry unauthorized goods and two of failing to keep records. Henderson was fined £10.

Mr. Wardlaw, who said that he would appeal to a High Court, accused the prosecution of presenting its case in a "slaphappy and careless" fashion.
