A ROMANIAN OPERATOR with a business arrangement described as -shoddy and dodgy" has been given the benefit of the doubt and allowed to apply for an 0-licence,despite his repute being "tarnished".

Joan Dan Todor, director for Northampton Freight Services (NFS), who also holds a licence as a sole trader, appeared before Eastern Deputy Traffic Commissioner Tom Macartney to defend his repute.

Todor was connected with another Romanian haulier,Florian Ciornei, who had his licence revoked and was disqualified for three years after TC Geoffrey Simms decided he was running as a front for another operator (CM 19 April).

Ciornei said he was buying one truck from Todor and hiring another. But there was no paperwork to prove this and suspicions were raised because Todor was also paying for the vehicles' insurance and fuel.There were also concerns that Todor's operating centre for NFS was given as the Super Sausage Transport Cafe on the A5 near. Towcester.

Todor said he had run into problems with two nominated transport managers, one of whom had been supplied by controversial agency Transconsult. He then wrote to the Traffic Area Office requesting a -period of grace" to take his CPC exam, but did not wait for confirmation to proceed.

Appearing for Todor. Ian Rothera said: -As a relative newcomer to the UK,MrTodor has kept a close relationship with fellow countrymen.There's a lot of smoke, but no fire at the heart of it."

Macartney said: "There are a number of things that have gone wrong and a number of things that appeared to be criminal."

But he added: -I've decided to believe you.Taking your own CPC is very impressive for someone whose first language is not English. I'm very impressed you did that and given the speed you did it you obviously passed first time.

"I'm going to revoke your licence as a sole trader but give you enough time to get organised and get a licence as a limited company. I'm not prepared to have a limited company based at a transport cafe; that can't he a good message to send out to anyone in the industry."
