Government over its fuel duty policy says a group of hauliers or a trade association would have more chance of victory.
Commercial litigator Peter Hastings. of Steeles Law, looked into the rates of duty and VAT levied on diesel after a request made by haulier Gary Cooper.
Hastings warns that a judicial review into HM Revenue and Customs' decisions on fuel tax rates would cost up to £15.000. But, he says he is keen to assist the industry

His findings showed the level of taxation was not anti-competitive (Judicial review of fuel duty policy is possible', CM 19 June). He says he didn't consider the Competition Act or case law, which could help show a UK act was created in breach of European law.
