by Elizabeth Daly • Spanish and French police are continuing to break European rules by fining British drivers for running their tachographs on UK rather than continental time.

In the latest incident a driver from Shepton Mallet operator Framptons International was stopped in Spain last week. European rules clearly say that tachographs should agree with the time in the vehicle's home country. But, despite top-level pressure from Britain, foreign police are still attempting to fine British drivers who are obeying the law.

The Department of Transport has successfully made representations on behalf of several operators in the past year and has obtained official assurances from both French and Spanish authorities that these companies will have their fines refunded.

In another effort to beat the problem, the Road Haulage Association has produced an explanatory note, in Spanish, which quotes the relevant clause from the European regulations. The idea is that drivers can show the sheet to Spanish police to apprise them of the law.

Mike Freeman of the RHA says: "This is yet another example of the Spanish police flouting the regulations and the general traffic police not knowing the law. With the regulation there is no ambiguity as to what the clause could mean and we hope that our explanatory note will help drivers sort things out on the spot before they get involved with courts and fines."
