West Midlands haulage firm nd one of its drivers were rdered to pay £4,713 between iem by Solihull magistrates ir breaking the hours regs.

VC Overland admitted 26 charges of permitting a driver to miss the regulation break and eight charges of not using a tachograph correctly. It was tined £2,720 with £913 costs.

Driver Anthony Gribbin of Stourbridge was fined £850 with £200 costs after admitting 20 charges of failing to take the regulation break. Helen Bradin, prosecuting for the Vehicle Inspectorate, told the court tachograph checks revealed that the equipment had not been used correctly and that Gribbin had not taken the required breaks.

"The Firm and the driver put road users at risk because of possible tiredness," she said. "The firm should have made sure the driver took the appropriate breaks," Malcolm Carless, defending, said the firm had a major contract delivering wheelchairs to various parts of the country. But there was no question of Gribbin driving around the clock, because he was not under pressure.

"Gribbin is a good driver," said Carless. "He is enthusiastic and experienced and did not put road users at risk."

One of the magistrates said: This was a serious catalogue of offences. The firm knew the problems but did not deal with them."
