Which of the following most accurately describes the problem?

A gross overload of a 3.5-tonne vehicle cost Waltham Cross-based Venus Foods and the driver of the vehicle E7,479 in fines and costs.

The firm and driver Uygar Ersoz admitted the offence before the Wrexham Magistrates.

The Magistrates were told that the two-axled Mercedes, which was laden with food, was stopped in a check at Ewloe in December.

When weighed, it was found the maximum permitted gross weight was exceeded by 2,220kg — some 63.43%. Furthermore, the maximum permitted weight of the first axle of 1,850kg was exceeded by 270kg — sonic 14..59% — and that of the second axle of 2,300k g by 1,300kg, which is some 56.52%.

The Magistrates fined the company £4,725 and ordered it to pay £313 towards the costs of the prosecution, plus a El% victim surcharge.

Ersoz was fined £2,205 and ordered to pay £213 towards the costs of the prosecution.

Licence granted for Aylward

PD Aylward (Contractors) has succeeded in a bid for a new 0-licence based at Horsham,West Sussex. The firm, whose sole director is Lynn Aylward, had sought a licence for four vehicles.

In May, the Transport Tribunal upheld the revocation of the licence held by her husband Paul Aylward, trading as Aylward Contractors, in the Western Traffic Area and his disqualification from holding an 0-licence in any Traffic Area for three months.

Philip Brown, the Western Deputy Traffic Commissioner, had been told that Paul Aylward's vehicles were not kept at Al dersh ot, but were located at premises in Horsham.

Paul Aylward accepted he had been operating from an unauthorised centre since 2004. He also agreed he had been operating as a limited company. Aylward (Contractors) Ltd since 2007 (CM 19 March). He subsequently resigned as a director of the limited company.

The Tribunal delayed the implementation of the revocation and disqualification orders until

14 May to enable the SEMTA application to be processed because there were no road safety implications (CM 21 May).

Action delayed for investigation

Consideration of action to be taken against the international licence for 18 vehicles and 3% trailers held by Northwich-based PE Blake & Son has been adjourned for a month while the possible falsification of maintenance records is investigated.

The company had been called before North Western Deputy Traffic Commissioner Mark Hinchliffe because of concerns over possible fraudulent documents, a large amount of mileage missing from tachograph records and drivers' hours infringements.

Three safety inspection records seen by a vehicle examiner had dates on which the tachograph records showed that the vehicles concerned were on the Continent. The DTC directed that a full investigation of the maintenance and taeho records be carried out before the hearing resumed.
