The exemption applies, at present, to drivers who fulfil both these conditions, not one or the other as your question implies. So far as can be ascertained, there is no proposal to dispense with this exemption when the EEC driving hours regulations are adopted in the UK. However, the position about this and many other exemptions applicable in this country has not yet been made plain and it remains to be seen if they are continued. Also to be determined is the possible continuation of the hours exemptions contained in the Drivers' Hours (Goods Vehicles) (Exemptions) Regulations 1972, for instance.
