II Norbert Dentressangle's fight to keep Its Eastern area 0-licence resumed at a Public Inquiry last week, with a new Traffic Commissioner on board to hear the case. Eastern Area TC Geoffrey Simms originally revoked ND's licence because of drivers hours breaches at its Aylesbury depot (CM 19-25 July 2001). ND appealed to the Transport Tribunal, which criticised Simms for failing to take account of ND's improvements since the offences (CM1-6 Nov 2001).

Chris Holdsworth, appearing for the Vehicle Inspectorate, told Western area TC Philip Brown that many of the Infringements were not minor indiscretions and nothing was being done to improve the situation: "There's got to be a change in the culture. If all the driver is going to get is a verbal warning or a memorandum then it's no surprise that certain people will carry on offending."

Appearing for the company, Steven Kirkbright said: "It doesn't matter what systems are set up—it's the results that count. Their offence rate on drivers' hours is now 0.7%. It is not a function of the VI to tell an operator how to run a business.., to criticise this system is not their job."

Tachograph chart analyst Gordon Humphreys told the TC: "The infringement on all offences is 2%. Compared with the industry standard this is vastly superior. The substantial reduction in offences show the system is working,."

ND's UK MD Patrice Schneider said: "The complexities of driver's hours are such that you have to train them. You would be failing them as an employer otherwise. We are all guilty of thinking the drivers are being stupid in missing this problem. But, how do we expect drivers to get it right all of the time when the VI get it wrong too?"

Brown will give his judgement in writing within 28 days.
