A County Durham haulier which was prosecuted last year for using a dangerous vehicle fallowing a fatal accident has lost Its licence after more maintenance failures were discovered. Stanley and Mabel Burn, trading as Burn Haulage, of South Hetton, had their licence for four vehicles curtailed at a public inquiry in September 2001.

The vehicle inveived in the accident, ifl which a schoolboy died, was given an immediate prohibition for 13 defects including a number of brake defects An undertaking was given that locking wheelturts would be fitted to the company's trucks, However, when the firm was called to a new inquiry before North Eastern Traffic Commissioner Tom Macartney, he said that its vehicles had attracted four more prohibitions for loose wheelnuts, two for overloading and two for defective brakes. He added that while it had fitted luminous wheelnut indicators, no locking nuts had been fitted.

Revoking the licence with effect from 18 May, the TC added that there had also been 12 convictions recorded against the firm and its driver's—vehicles had clearly not

been kept fit and serviceable.

Vehicle Examiner Neil Atkinson told the inquiry that an examination of the firm's tachograph records had revealed many minor dii-hour driving offences. and the speed limiter in one vehicle had not been operational for some time.

Partner and transport manager Stanley Burn said locking wheelnuts had only Just been fitted as he had misunderstood the previous undertaking. However, McCartney ruled that Burn had lost his repute and said it would not be regained until he has passed the CPC exam, his current CPC having been obtained under grandfather rights.
