II Cambridgeshire truckstop proprietors Jenny and Peter Hawes have lost their case to continue operating their roadside café.
After a week-long trial at Cambridge County Court, Judge John Sennitt ruled in favour of the Department of Transport, which has been waging a twoyear legal battle to reclaim poskssion of the land off the A47 at Chapel Lane, near Wisbech. Sennitt gave the Hawes 28 days to leave their layby site.
However, the judge accepted the Hawes' claim that the DOT had suggested moving the cafe to Chapel Lane following a decision to close the layby at Guyhirn where they used to be based. He criticised the DOT's action as "unwise".
The DOT is not seeking any costs against the couple.
The Hawes', who have invested over £20,000 in the "Sit in Café", say they will comply with the repossession order but may appeal against the decision.
