Which of the following most accurately describes the problem?

• A South Humberside driver is choosing to go to court rather than pay a 140 fixed penalty notice imposed for an allegedly dangerous load which the driver insists was completely safe.

Jim Brewitt, who drives for South Killingholme, South Humberside general haulier Yeagers Freight, says the problem centres on a box he keeps in the back of his Mercedes 2534 containing trailer lenses.

The box is restrained by bungee straps and had been on the back of the truck for 160km and "had not moved an inch", according to Brewitt, before he was cautioned and given the penalty notice.
