Which of the following most accurately describes the problem?

service vehicle which is not carrying passengers, ie when it is being driven between depots? Does the driver require a psv or hgv licence?

Could a DoE vehicle examiner demand to see a vehicle inspection card containing details of work which has been done four days previous to his weekly visit?

Is there any legislation laid down by the Government or any other body preventing heavy commercial vehicles using country lanes?

A Section 144(1) of the Road Traffic Act 1960 .requires that a person shall not drive . . . a public service vehicle on a road unless he is licensed for the purpose. Section 117(1) defines a public service vehicle as a motor vehicle used for carrying passengers for hire and reward which is either carrying passengers at separate fares or is not carrying passengers at separate fares but is adapted to carry eight or more passengers.

In these circumstances, because the vehicle you quote is a vehicle used for carrying passengers for hire and reward and, presumably is adapted to carry eight or more passengers, the driver, if the vehicle is on a road, will require a psv licence.

As far as your second question is concerned, a DoE vehicle examiner is empowered under Section 82 of the Transport Act 1968 to require any person to produce • and to permit him to inspect and copy any record or document . . which that person is required by the Act to preserve It is not clear why any doubt should hay( arisen about a record of vehicle inspectior carried out four days previously.

There is no legislation which prevent; heavy commercial vehicles using countr3 lanes other than those which might hay( been imposed for special reasons such a; weight restriction and so on.
